WORKMENS COMPENSATION ? APPEAL AND ERROR. 1. Workmens Compensation ? Appeal and Error ? Findings sustained. Where district court has sustained findings and conclusions made by Industrial Accident Board, Supreme Court must sustain ruling unless record clearly preponderates against it. 2. Workmens Compensation ? How compensable injury must arise. A compensable injury must arise out of and within scope of employment by employer concerned, and at all times the right to receive compensation must depend on the particular facts and circumstances of the particular case. 3. Workmens Compensation ? Evidence sustained finding claimant not entitled to award. In workmens compensation proceeding, evidence sustained finding that employee, designated by union as job steward, who was injured in automobile accident after working hours while driving to union meeting in order to turn in dues collected and applications for new membership, was not within scope of employment at time of accident.
